General Terms and Conditions

1 - Acceptance of conditions
The customer acknowledges having read, at the time of placing the order, the special conditions of sale set out on this screen and declares accepting them unreservedly.
The present general conditions of sale govern the contractual relationship between Figuresdesign and its customer, both parties accepting them unreservedly. These general terms and conditions of sale shall prevail over any other terms and conditions appearing in any other document, unless expressly waived in advance in writing.


2 - Products
The photographs illustrating the products are not contractually binding. In the event of errors, Figuresdesign cannot be held responsible.


3 - Ordering
Automatic recording systems are considered as proof of the nature, content and date of the order. The sale will only be concluded once payment has been received from the customer. Figuresdesign will confirm acceptance of the order to the customer by e-mail to the address provided. If a product is out of stock but a customer has ordered this product before the Figuresdesign company has had time to remove it from the site, the Figuresdesign company undertakes to reimburse the customer immediately by bank transfer or check. The company Figuresdesign reserves the right to cancel any order from a customer with whom there is a dispute over payment of a previous order. The information provided by the purchaser when placing an order is binding on the purchaser: in the event of an error in the recipient's contact details, Figuresdesign cannot be held responsible for the impossibility of delivering the product.


4 - Delivery
On receipt of payment: delivery within one to six weeks. In the event of stock shortage, the delivery time may be extended.
In accordance with articles L.121-16 to L.121-20 of the French Consumer Code applicable to distance selling, the Figuresdesign company undertakes to respect the following conditions:
Deliveries in Metropolitan France are made by Mondial Relay, La Poste (Colissimo suivi) or any other carrier selected by Figuresdesign. Deliveries to EEC countries are made by Mondial Relay or La Poste in Colissimo. For deliveries outside the EEC, international postal services are used.
For deliveries outside mainland France, the customer undertakes to pay the cost of transport and all taxes due on the export of products, customs duty, value-added tax and any other taxes due under the laws of the country in which the order is received.
Goods always travel at the recipient's risk. Always check your parcel on arrival. You have 48 hours in which to notify the carrier of any shortages or damage.


5 - Prices and payment
Prices are indicated in euros. The price of products is payable in cash on the day the order is placed.
The price indicated on the order confirmation is the final price, not subject to VAT. This price includes the price of the products, handling and packaging costs. The cost of transport is added to the price of the item and is charged to the customer.
Payment can be made by Paypal, cheque or credit card online. Online payment by credit card is made on a secure server thanks to our partner Stripe. Each time you place an order, you will receive an e-mail confirming the details of your order and its total amount.


6 - Withdrawal
In accordance with article L.121-16 of the French Consumer Code, the customer has a period of 14 clear days from delivery of the order to return the product for exchange or refund, without penalty except for the cost of return. Return shipping costs are at the customer's expense.
Products must be returned in their original packaging, in the condition in which they were received.
Reimbursement is due within a maximum of 15 days.


7 - Litigation
The present contract is subject to French law. The responsibility of the company Figuresdesign, will, in any event, be limited to the amount of the order and can not be held liable for simple errors or omissions that may occur despite all precautions taken in the presentation of products.
Figuresdesign cannot be held responsible for any damage of any kind, whether material, immaterial or physical, which may result from the malfunction or misuse of the products marketed. The same applies to any product modifications resulting from manufacturers.
In the event of difficulties in the application of the present contract, the purchaser has the possibility, before any legal action, of seeking an amicable solution. The search for an amicable solution does not interrupt the "short period" of the legal warranty, nor the duration of the contractual warranty.
Complaints or disputes will always be received with attentive benevolence, good faith always being presumed in those who take the trouble to explain their situation.
In the event of a dispute, the customer should first contact the company for an amicable solution. Failing this, the Commercial Court of Paris shall have sole jurisdiction, regardless of the place of delivery and the method of payment accepted. The site is the property of the Figuresdesign company in its entirety as well as the rights pertaining thereto. Any reproduction, in whole or in part, is subject to the authorization of the owners.
In accordance with the French Data Protection Act no. 78-17 of January 06 1978, you have the right to access and rectify your personal data. This information is used exclusively to personalize the present site and is not transmitted to any third party.


8 - Liability
Any order placed by a customer is for his/her personal use or for the personal use of the person to whom the delivery is made. In the latter case, the customer undertakes on behalf of this person to accept the present general conditions of sale.


9 - Legal information
The personal information collected for the purposes of distance selling is compulsory, as this information is essential for the processing and delivery of orders. Failure to provide this information will result in the order not being validated. In accordance with the French Data Protection Act (Loi Informatique et Libertés), the processing of personal information relating to customers has been declared to the French Data Protection Authority (Commission Nationale de l'Informatique et des Libertés - CNIL). The customer has the right to access, modify, rectify and delete data concerning him/her (art. 34 of the law of January 6, 1978), which he/she may exercise by contacting Figuresdesign. Furthermore, the Figuresdesign company undertakes not to communicate, whether free of charge or in exchange for payment, the contact details of its customers to a third party.
